New Jersey’s litigation environment continues to be volatile. The constant erosion of legal protections for healthcare providers, ever-increasing demands of plaintiffs' attorneys, and the lottery mentality of some juries continue to drive the severity of losses higher.
Severity – the size of each loss – represents just one component in the process. How often we prevail in defending the claim, the frequency of success, is another.
Thanks to the outstanding efforts of our Claims Department, Princeton Insurance experienced a successful year defending its policyholders. For NJ institutional policyholders, 83 percent of all claims were closed without indemnity payment – up almost seven percent since 2001. For NJ individual policyholders, 80 percent of all claims were closed without indemnity payment, the same percentage as in 2003.
In addition, of the 98 New Jersey cases that were tried to a conclusion in 2004, 84 were found in favor of our policyholders, a success rate of 86 percent. |
